Yes, you have essentially re-keyed the classified info into an unclassified system. And you would be in big trouble for intentionally sending that info unless it was not in fact classified or otherwise declassified - obviously not everything on the classified system is or remains classified. But the recipient has little control over what emails they receive and in general would not expect to receive unmarked classified information on a non classified email account, .gov or any other.

Hard to claim someone intentionally received an email.

ok now we are getting somewhere...
Again, here's what the paragraph with the ( c ) said:

“Purpose of Call: To offer condolences on the passing of President Mutharika and congratulate President Banda on her recent swearing in.”

Hard to imagine anyone would think this was classified, ( c ) notwithstanding. In any case, Hillary was the recipient.

So now we need to dig up the other incriminating email.

FBI investigators reviewed the 30,000 emails Clinton turned over to the State Department in 2014. The investigation found "a very small number" contained classification markings at the time they were sent.
one is enough...

so your defense here is the c was really irrelevant and Hilary was ignorant of it's existence on her private, unsecured, unauthorized server that virtually anyone could access...that's not a defense, it's incrimination...

So far, your blockbuster email scandal boils down to Hillary received an email from an aide about expressing condolences for the passing of a foreign dignitary. This email had a ( c ) in it. Hillary also did not backup her emails properly.

Virtually anyone could access. Now that is a reach. I bet you couldn't. I'm betting 99% of people out there couldn't. Personal email systems have been used by many in state department. She is not the first.

actually no hillary is the only one we know of who used a private server...others used a private email address hosted by a commercial server...

as far as teh security of her server:
During testimony before Congress on Thursday, FBI Director James Comey stated that the servers maintained by presumptive Democratic presidential nominee former Secretary of State Hillary Clinton were less secure than a Gmail account.

Comey was asked whether a previous statement he made comparing Clinton’s servers to Gmail was implying “that the private email servers of Secretary Clinton’s were perhaps less secure than a Gmail account, that is used for free, by a billion people around this planet?”

He answered, “Yes, and I’m not looking to pick on Gmail. Their security is actually pretty good. The weakness is in the individual users. But, yes, Gmail has full time security staff, and thinks about patching and logging and protecting their systems in a way that was not the case here.”
you be the judge there...seems it was weak at best, and nowhere near as robust a .gov server would presumably be...we also have no idea what was actually deleted from that server (after a subpoena was issued)...

Just because it is a commercial doesn't make it more secure. A commercial outfit will have more surface area to secure. There are no providers that just host email.

Nikoli wrote:Can someone explain to me how Classified documents got off of the internal DOD networks? You cannot email yourself TS documents. You cannot forward them. Please explain?
The only way to transmit a document from the classified system is to re-type it into a unclassified one. Hillary must have re-keyed guess ya never heard of copy and paste?hundreds or thousands of top secret documents and emailed them to herself. This would explain the lack of classified headings and also demonstrate her clear intent. Comey presumably covered it up.

It'll all come out in the big trial they are expecting.
right so comey must have been wrong when he determined that there was classified info in her emails...he was wrong about nearly everything else too...we need to have a new investigation to clear hillary's good name...
Pretty hard to copy and paste between two different computers on two different networks unless the classified system permits access to and/or from an unclassified system. Hey, that could be the security flaw Clinton willfully took advantage of all along. Look for mention of it in the memo.
jesus does everything have to be explained to you guys...copy document, paste into word or other text editing program and email ...

the argument you and nucklehead are making is that the classified info that the FBI determined was on her computer wasn't on her computer cuz it's not possible...

clearly that can't happen, it's impossible butters isn't allowed to fly the drone without supervision...

There in no way to move information out of that system without jumping through a ton of hoops. Ask Edward Snowden the level of expertise required. It is the discussion of those documents outside of that network. Nothing more.
Oh Edward Snowden, the guy who made off with gigabytes of government documents that could only have been stolen off a secured system by using a plug in hard drive. And you are telling me that Clinton or one of her lackeys could not spirit classified info the same way?

The .gov accounts have been hacked at least 3 times that we know of. No evidence that Clinton's server was ever hacked.

Virtually anyone could access. Now that is a reach. I bet you couldn't. I'm betting 99% of people out there couldn't. Personal email systems have been used by many in state department. She is not the first.
I'd say the takeaway here is:

The server's hardening was not commensurate with minimum security requirements.
The mobile device used by Hillary to access information of the server was not commensurate with minimum security requirements.
Individuals with administrator access to the server and the information it contained did not have the proper security clearances.
The implementation was not compliant with the Federal Records Act

If something similar happened at a private company in a highly regulated industry and put the nation's security or health at risk ... something tells me the reaction would be different.

I would also argue the 99% is wishful thinking. It's easier to get into a server than you think ... especially given all the attack vectors Hillary provided due to the careless implementation of her defenses.

of particular concern:
With regard to the 700K campaign donation that McCabe's wife received while she was running in Virginia for a state senators seat. It's been reported that a race like that is usually around a 50K race, which would have been well known to any of the Hillary campaign people. So, why such a LARGE donation relative to the usual cost of the race? How much did the actual race cost McCabe's wife?

The original concern was that McCabe didn't recuse himself but we all may have completely misconstrued what actually was going on.

In Virginia, campaign donations are allowed to be kept by the candidate after the race. This "donation" is looking more and more like a bribe or payoff than what it was purported to be.
