I'd be shocked if the data source(s) to be used for this policy wasn't explicitly specified in the insurance agreement.

And, assuming those sources were the National Weather Service and Weather Analytics, then it doesn't really matter what the temperature was at the Mountain.

The methodology that Weather Analytics used to estimate the on-mountain temperature should also have been known and agreed-to by both sides when the agreement was signed.

That the after-the-fact answer wasn't to Mountain Creek's liking doesn't give grounds to sue and claim the methodology was "complex". I'm guessing if the answer had instead gone in their favor they'd take the money.

Looks to me as if they're arguing over about half of the $1.7 million - the difference in the number of days as calculated by Mountain Creek and the number of days as calculated by the weather services in question. It'll be negotiated and settled out of court unless, of course, people get stupid.
