While he is no longer a player, he was a player when his actions took place.
MLB obviously doesn't want to piss off the players.

If they punished one player they would have to punish them all, many are now on different teams so suspending them wouldn't be hurting the astros, it would be hurting the teams they play for now. MLB did not want to touch that with a 10 foot pole, and had no interest in bring the union into it.
