Clinton was not prohibited from using a private server and these emails would have landed on a unclassified system had Clinton used a .gov account.

So what about the FBI's October 28, 2016 proclamation of investigating new Clinton emails that ultimately turned out to be completely irrelevant? I suppose this was a very clever way of providing cover for FBI malfeasance while at the same time generating overwhelming momentum for a Clinton victory. Well played FBI.

Only one person has ever been charged under the gross negligence theory (a spy) and nobody has ever been convicted.

Article 92 of the UMC has a "knew or should have known" standard, but this does not apply to State Department civilians.
