The Fulton County District Attorney’s office said some fake electors for Donald Trump have implicated each other in potential criminal activity and is seeking to disqualify their lawyer, according to a new court filing.

The district attorney’s office is requesting that attorney Kimberly Bourroughs Debrow be disqualified from representing a group of 10 Republicans who served as electors for the former president in Georgia – a state Trump lost to President Joe Biden. The DA’s office also accused the lawyer of failing to present an immunity deal to her clients last year, according to the filing.

The new filing offers the latest indication that immunity offers could still be in the works months after Fulton County District Attorney Fani Willis suggested charging decisions were “imminent.”

In mid-January 2021, two men hired by former President Donald Trump's legal team discussed over text message what to do with data obtained from a breached voting machine in a rural county in Georgia, including whether to use it as part of an attempt to decertify the state's pending Senate runoff results.

The texts, sent two weeks after operatives breached a voting machine in Coffee County, Georgia, reveal for the first time that Trump allies considered using voting data not only to overturn the results of the 2020 presidential election, but also in an effort to keep a Republican hold on the US Senate. 

"Here's the plan. Let's keep this close hold," Jim Penrose, a former NSA official working with Trump lawyer Sidney Powell to access voting machines in Georgia, wrote in a January 19 text to Doug Logan, CEO of Cyber Ninjas, a firm that purports to run audits of voting systems.

In the text, which was obtained by CNN and has not been previously reported, Penrose references the upcoming certification of Democrat Jon Ossoff's win over Republican David Perdue.

"We only have until Saturday to decide if we are going to use this report to try to decertify the Senate run-off election or if we hold it for a bigger moment," Penrose wrote, referring to a potential lawsuit.

The plot to breach voting systems in Coffee County, coordinated by members of Trump's legal team including Rudy Giuliani and Sidney Powell, is part of a broader criminal investigation into 2020 election interference led by Fulton County District Attorney Fani Willis.

Specifically, Shafer’s attorneys say their client was relying on “repeated and detailed advice of legal counsel” when he organized a group of “contingent” electors from Georgia and served as one himself, thus “eliminating any possibility of criminal intent or liability,” according to a copy of the May 5 letter.

I think the argument is a slight shade different than that. To be convicted, you need criminal intent, i.e. that you intended to do something that you knew or should have known was against the law. So the defense is, how could they have known this was against the law when their legal counsel advised them that this was an acceptable course of action under the law?

I'm not saying the defense would work. After all, if your lawyer told you that shoplifting wasn't illegal, I doubt that would be a very solid defense to shoplifting.

A valid point I am sure the prosecution is sure to raise. Of course the defense might say, these are officers of the court who have a duty not to give people bad legal advice or to advise people to do things that are illegal. But again, I'm not sure this argument can carry the day.

Trump desperately needs to win over independents and last nights townhall on CNN will do anything but that.
