I asked the same question on Alpinezone of what happens to the lifts if POWDR doesn't win.
This thing has gotten so ridiculous! Is this a trial or the script to Dumb and Dumber 2?

Maybe they can take the lifts down at PCMR and send the good ones to Killington.

It is also my understanding that the lifts are affixed to and come with the land. PCMR/POWDR lives in a fantasy world if they think they will be allowed to take them.

I don't think anyone/us can make a intelligent call on all this without having sat thru all the testimony/documents so far.

I would think that something like this would end up at the USSC.

The idiots in Park City should've renewed their lease, it couldn't be any more BLACK AND WHITE. Talisker is clearly the more savvy business operator. Once they realized that Powder didn't renew their unbelieveably cheap lease,they saw the $$ signs. They said hey Vail you want to lease the Canyons and Oh by the way we own most of the land PCMR sits on and Powder forgot to renew their lease. Think of what that does for your company.

Yes but not being a lawyer myself, I'd think that since they kept cashing the checks without asking for the lease renewel that it could mean, to PWDR, that it was status quo.

The USSC deals with many things less important that property rights.

don't know if anyone saw this in the comment section of one of the stories...if true, hard to make a case on PCMR's side.

"This is an embarrassment of the largest proportion for Ian and John Cumming. Not much could be worse than everyone in the skiing world knowing the idiots John hired for managerial positions were too stupid to look in the desk of a departed financial executive, and that he didn't personally oversee this issue months before the deadline. Everyone knows a backdated lease is wrong, and some think it is fraudulent. No one wants to be a case study for business schools unless they do something right. This dispute is going to be a case study about corporate mismanagement and stupidity.

Whenever an employee leaves, even on friendly terms, you check his/her emails, desk drawers, office, phone records, etc. to insure no harm was done to the firm or the customers. A CFO left and these clowns never looked in his desk drawer. That is where the lease was gathering dust! Yes, this will be a case study for MBA candidates at Harvard, Northwestern, etc.

I'll bet that former CFO is ROTFLHAO, particularly since he was replaced by someone with lesser credentials. We'll leave discussions about revenue recognition rumors for another day."

Reading the comments of many of these articles, I get the impression that there are many people out there with a grudge against POWDR and Cumming.

This might be the best way to get lifts for the interconnect too. Seems like it will work out well.

As much as I hate to admit it, the case for Powdr does not look good. I think this right of first refusal being denied with change of control in Talisker is their best shot at winning.

Pretty childish threat move by PWDR ... kinda like taking their ball and going home.
Only problem with that is they may not have a home left.

Would a Vail injunction include a no trespassing clause?
Gonna be tough removing lifts and towers without boots on the ground.

Hoping these idiots figure out a way to settle.
