Speaking of Fox News ... they're laughing all the way to the bank. Since Dominion has to prove malice ... there's a good chance Fox won't see any material consequences.

My conservative friends say it's old news and the future is more important than the past and that this 'doesn't change much'. :roll:

“Sidney Powell is lying,” Tucker Carlson wrote to a producer about the Trump lawyer, who once claimed in a guest spot that voting technology companies “flipped” Trump votes to Biden.

“Terrible stuff damaging everybody,” wrote company founder Rupert Murdoch, about wild claims raised by Powell and fellow Trump adviser Rudy Giuliani. The recipient of his note, Fox News CEO Suzanne Scott, agreed. In another message, Murdoch referred to the claims as “really crazy stuff” and said that it was “very hard to credibly claim foul everywhere.”

And of Giuliani, the former mayor of New York, Fox’s prime-time roster seemed to share a common opinion during these fraught weeks.

He’s “acting like an insane person,” wrote Sean Hannity, star of the network’s 9 p.m. show, while his 10 p.m. colleague Laura Ingraham concurred: “Such an idiot.”

The messages are part of a cache of internal correspondence and deposition testimony released Thursday in a $1.6 billion defamation lawsuit against the network filed by Dominion Voting Systems, one of the two election software companies at the center of the conspiracy theories.

At what point does knowingly promoting false narratives that result in high ratings and income but obviously also results in damage to a company or nation cross into malicious intent?

Under the high legal bar of actual malice, defined in that 1964 U.S. Supreme Court decision involving The New York Times, Dominion has to show Fox acted either with knowledge that what it was broadcasting to the public was false, or that it acted with reckless disregard of the truth.

I can't access the article, but judging by just the emails you posted, it appears that Fox "journalists" had serious doubts about the story but ran it anyway. That's perilously close to acting with reckless disregard of the truth. But the devil is in the details. What did Fox actually broadcast, specifically? Did they say things like, "A source reported X,Y,Z.." and if so, did they have reason to doubt the veracity of the source? Did they do any due diligence? Did they couch their statements as opinion, or assertions of fact? All that nuance matters, so without looking at the actual evidence in the case, it's pretty tough to say.

What Fox is hoping for is for a judge to enter summary judgment that there is insufficient evidence that Fox acted with actual malice. If they don't get that, and given what the NPR article says they probably won't, the case goes to a jury. Most civil litigants don't care to gamble the case before a jury and choose to settle out of court. I imagine that's the most likely outcome, here, and if that happens it will probably be subject to a confidentiality clause and we'll never know what it settled for.

Well, all the major news is reporting that Trump had indeed been indicted. They all but seem to be having orgasms over it. This indictment means almost nothing as its over a very minor campaign violation of using campaign funds to pay back Cohen for paying off Stormy Daniels. No jail time will come from it. How about we keep the powder dry for January 6 investigations!!

Bigger story here is how Republicans in Congress are going after a state DA.

Well that and Fox News hosts warning folks to be careful cuz Trump supporters aren’t going to take it.

This indictment and the more serious investigations with severe penalties aren't mutually exclusive. Both can and should happen if laws were broken. I have no problem for the scumbag having to go through a trial for the Stormy Daniels payments. If what he did was illegal, then he should pay the fine.

Trump will be able to rally "Mid-Western military aged men" to fight a war against "Evil Iran". These "(Mid-W) guys" have little prospects in the current (shitty) system and love and buy into MAGA Trump BS. What were we thinking with this Ukraine war? Push Russia and China closer together. Sorry, not sorry but Russia is winning this war. Resource giant that is friendly with Iran + Industrial giant.... Sanctions on Iran lolololol. Sanctions on anyone who doesn't buy into our values.... Israel is going to push us into a war with Iran ASAP and Trump will be the answer for neo-con zionists to get our Mid-Western youth to fight and die for our "woke" to put it in the most "PC" terms; values. I can't tell if you are drunk or just a poor writer, but I think I understand what you're trying to convey.

I'm not sure why you think Trump is going to be some greater recruiter of Mid West soldiers to fight wars he doesn't believe in. Wouldn't he also have to be president again to do that?

What does any of this have to do with using campaign funds to settle debts for hush payments to a porn star?
